An appeal is basically asking a judge to review the social security agency’s denial of your claim.  If your claim is denied by social security, then you usually have a 60-day deadline to file an appeal.  If you miss the deadline then you may need to start all the way from the beginning.  The most important advice that I can give is to consult with a lawyer as soon as you receive the denial letter.

I recently did a consult with a person from Purvis Mississippi that waited to call over 60 days after receiving the denial letter. Unfortunately, we were unable to file an appeal because the deadline has passed.  The person will now have to refile a new application. Worse, she will likely receive less back pay because she missed the deadline.  If she had called us earlier and filed a timely appeal, her back pay would have started not on the original date she filed her application.  Now that she missed the appeal deadline her back pay date will begin on the date of the second application.  She has potentially lost 6 months worth of benefits because of missing the deadline.

Most people file the initial social security claim without a lawyer.  Many people can complete the paperwork themselves. You can even apply over the phone if you are not good with paperwork.  A lawyer doesn’t typically get involved until a claim is denied. If you believe that your claim was wrongly denied, then you can file an appeal.  It is usually best to have a lawyer to help you with an appeal.
